8. Underground Utilities and Site Conditions
The Client is solely responsible for identifying, locating, and clearly marking all underground utilities and site conditions prior to the commencement of any work. This includes, but is not limited to, private utility lines and systems such as irrigation, septic systems and drain fields, invisible pet fencing, private electrical lines, water lines, gas lines, drainage systems, cable, fiber optic lines, and any other underground structures not marked by public utility locating services.
The Client must contact 811 (or the applicable state utility locating service) prior to the scheduled start date when required by law. The Client acknowledges that public utility marking services do not identify private utility lines and that it remains the Client’s responsibility to ensure all private utilities are properly identified and marked.
IronRoot Services will exercise reasonable care to avoid properly marked utilities; however, IronRoot Services shall not be liable for any damage to utilities, lines, systems, or underground conditions that are unmarked, improperly marked, inaccurately located, or undisclosed prior to the start of work.
IronRoot Services reserves the right to delay or suspend work if utilities are not properly identified or if site conditions present a safety concern.
